Filing with Children
Contrary to popular belief you can obtain an uncontested divorce even if you and your spouse have a child/children together. Regarding the child and child support is an issue that has to be handled before filing for an uncontested divorce. This is done by filing for child support and custody at your local county courthouse. A judge will issue an order which you will need to supply with your uncontested divorce papers. Before you file the support and custody try and work out your arrangment with your spouse first. You can your spouse can get together and write up what you have agreed on. This is similar to a separation agreement but only deals with child support and custody.
Write out your agreement regarding the child and take is to a local notary public. They will stamp the paper which makes it a legal agreement. You then take that paper with you when you go to court and the judge will more than likely issue what you have both agreed on. The judge will then give you a document stating what the terms are (make sure you ask the judge for a certified copy, which is a bit different than the normal copy given out. That is the paper you will need to submit with your uncontested divorce paperwork). The certified judgment is what you file with your uncontested divorce paperwork.
